Please read these Terms & Conditions ("Terms") carefully. By accessing or using the ApplyLynk website, applications, partner portal, and services (collectively, "Services"), you agree to be bound by these Terms, which form a legally binding agreement between you ("User," "Student," "Institution Representative," or "Partner Institution") and ApplyLynk ConversionX Private Limited ("ApplyLynk," "we," "us," or "our"). If you do not agree to these Terms, do not use our Services.
By using our Services, you confirm that you are at least 18 years of age and legally capable of entering into a binding agreement.
1.1. Consent for Minors (Under 18):
If you are under 18 years of age (a "Child" as defined by the Digital Personal Data Protection Act, 2023 - DPDP Act), your use of our Services signifies that you have obtained the verifiable consent of your parent or legal guardian to use our Services and to the processing of your personal data as described in these Terms and our Privacy Policy. By continuing to use our Services, you and your parent/legal guardian represent and warrant that such verifiable consent has been obtained. ApplyLynk reserves the right to implement reasonable measures to verify age and parental consent.
ApplyLynk strictly prohibits the tracking, behavioural monitoring, or targeted advertising of Children, in compliance with the DPDP Act 2023.
Should we be notified or determine that a Child's data has been processed without such verifiable parental or guardian consent, or if such verifiable consent is reported as withdrawn or invalid, ApplyLynk will promptly remove all personal information about that Child from its databases and discontinue their access to our Services. It is the responsibility of the parent or legal guardian to ensure the accuracy of the child's age and to notify ApplyLynk immediately if a child is using the Services without proper consent.
ApplyLynk provides a platform to assist students in finding colleges, universities, study abroad programs, distance learning opportunities, information on exams & results, and education loan assistance. We also offer a partner portal for institutions and consultants to register, list, and manage their details and programs.
ApplyLynk collects and processes personal data to provide and improve its Services, in compliance with the Digital Personal Data Protection Act, 2023 (DPDP Act) and the General Data Protection Regulation (GDPR), where applicable.
3.1. Types of Data Collected:
For Students: Name, contact information (email, phone number, address), academic history, preferences (courses, institutions, countries), financial information (for loan applications), exam results, and other data relevant to college admissions and study abroad processes.
For Institution Representatives/Partner Institutions: Name, contact information (email, phone number, address), designation, institution details, program offerings, accreditation information, and other data necessary for partnership management.
Usage Data (including Cookies, Geo-fencing, and IP Tracking): We automatically collect information about your interactions with our Services. This includes, but is not limited to:
IP addresses: To identify your general location, for security purposes, and to analyze user behavior patterns.
Browser type and device information: To ensure compatibility and optimize your viewing experience.
Operating system: For technical support and service optimization.
Referral URLs: To understand how you found our site.
Pages viewed, time spent on pages, clickstream data: To understand your interests and how you navigate our Services.
Geo-fencing data: Collected through your device's location services (if enabled) to provide localised services or relevant content, and to track user behaviour for service improvement. You can disable location services on your device if you do not wish for this data to be collected.
IP tracking: Used in conjunction with other data to track user behaviours and communication for improvement in our services. This includes understanding demographics, engagement patterns, and optimising service delivery.
3.2. Purpose of Data Processing:
Your personal data is collected and processed for the following purposes:
To provide and personalize our Services, including matching students with suitable institutions and programs.
To facilitate applications, inquiries, and communication between students and institutions/consultants.
To process education loan applications and related financial services.
To manage and maintain your user account and profile.
To improve our Services, develop new features, and enhance user experience through analytics and behavioral insights.
To send important service-related communications, updates, and promotional materials (with your explicit consent where required).
To analyze user behavior and preferences (via cookies, geo-fencing, and IP tracking) to personalize your experience, optimize content, and improve our service offerings.
To ensure the security and integrity of our Services and prevent fraudulent activities.
To comply with legal obligations and regulatory requirements.
3.3. Legal Basis for Processing (GDPR Compliance):
For users located in the European Union/European Economic Area, our legal bases for processing personal data include:
Consent: Where you have given explicit consent for specific processing activities (e.g., for marketing communications, and the use of non-essential cookies and tracking technologies).
Contractual Necessity: Processing necessary for the performance of a contract with you or to take steps at your request before entering into a contract (e.g., providing college matching services).
Legal Obligation: Processing necessary to comply with a legal obligation (e.g., tax laws).
Legitimate Interests: Processing necessary for our legitimate interests or those of a third party, provided those interests are not overridden by your fundamental rights and freedoms (e.g., improving our services, preventing fraud, direct marketing where permissible).
4.1. What are Cookies?

5.1. General Consent:
By using our Services, you provide your free, specific, informed, unconditional, and unambiguous consent for ApplyLynk to collect, process, and share your personal data as described in these Terms and our Privacy Policy, in accordance with the DPDP Act 2023 and GDPR. You will be provided with clear notice regarding the type of data collected and the purpose of its processing at the point of collection or through our Privacy Policy.
5.2. WhatsApp Consent for Communication:
By providing your mobile number and explicitly opting in (e.g., by checking a box or clicking "Agree" during registration/inquiry), you consent to receive communications from ApplyLynk, and from the institutions/consultants you interact with through our platform, via WhatsApp. These communications may include service updates, application status, reminders, and relevant promotional information. You understand that standard message and data rates may apply. You can withdraw this consent at any time by replying "STOP" to a WhatsApp message or by adjusting your communication preferences in your ApplyLynk account settings.
5.3. Email and SMS Communication:
By registering or inquiring through our Services, you consent to receive communications from ApplyLynk via email and SMS regarding your account, service updates, and promotional offers. You can opt-out of promotional emails and SMS by following the unsubscribe instructions provided in the messages or by managing your preferences in your account settings.
6.1. Sharing with Institutions and Consultants (for Students):
To fulfill your requirements and facilitate your educational journey, we share your relevant personal information (e.g., academic details, preferences, contact information) with colleges, universities, and education consultants ("Partner Institutions" and "Consultants") listed on or associated with our platform. By submitting your information or expressing interest in an institution/program, you explicitly consent to this sharing. Partner Institutions and Consultants are obligated to handle your data in accordance with their own privacy policies and applicable data protection laws.
6.2. Sharing of Institution Personal Data (Partner Portal):
When institution representatives register on our partner portal, or when our team updates institution details, we collect and store personal data of institution representatives (e.g., name, contact details, designation) as well as comprehensive institution details (e.g., programs, fees, accreditation). By registering or providing this information, institution representatives consent to this collection and storage. This information, including the personal data of institution representatives and the institution's details, will be shared with students and consultants who use ApplyLynk's Services to connect with institutions and fulfill their educational requirements.
6.3. Third-Party Service Providers:
We may engage third-party service providers (e.g., cloud hosting, analytics, payment processors) to assist us in operating our Services. These providers may have access to your personal data only to perform services on our behalf and are obligated to protect your data in compliance with applicable laws and our privacy standards.
6.4. Legal Requirements and Business Transfers:
We may disclose your personal data if required to do so by law or in response to valid requests by public authorities (e.g., a court order or government agency). In the event of a merger, acquisition, or sale of all or a portion of our assets, your personal data may be transferred as part of that transaction, provided the acquiring entity agrees to adhere to these Terms and applicable privacy laws.
7.1. Use of User-Generated Content:
By submitting or sharing video testimonials, reviews, or other content ("User Content") to ApplyLynk through any means, or by tagging/mentioning ApplyLynk on YouTube or other social media platforms in content related to your experience with our Services, you grant ApplyLynk a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content (in whole or in part) and/or to incorporate it in other works in any form, media, or technology now known or later developed, for marketing, promotional, and commercial purposes related to ApplyLynk's Services.
7.2. Reposting and Monetization on YouTube:
You explicitly consent to ApplyLynk reposting your User Content on ApplyLynk's official YouTube channel(s) and other social media platforms. You further agree that ApplyLynk has the right to monetize such reposted User Content through advertisements or other monetization programs offered by YouTube or other platforms, without any obligation to pay you royalties, fees, or other compensation. You acknowledge that ApplyLynk is not obligated to use your User Content and may remove it from its channels at any time. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish the User Content and to grant ApplyLynk the rights contained herein.
We implement reasonable technical and organizational measures to protect your personal data from unauthorized access, use, disclosure, alteration, or destruction. However, no method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your personal data, we cannot guarantee its absolute security.
We retain your personal data for as long as necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, or reporting requirements. When your data is no longer required, we will securely delete or anonymize it.
Under the DPDP Act 2023 and GDPR (where applicable), you have certain rights regarding your personal data:
Right to Access: You have the right to request access to the personal data we hold about you.
Right to Correction/Rectification: You have the right to request the correction of inaccurate or incomplete personal data.
Right to Erasure (Right to be Forgotten): You have the right to request the deletion of your personal data under certain circumstances.
Right to Data Portability: You have the right to receive your personal data in a structured, commonly used, and machine-readable format and to transmit that data to another controller.
Right to Object/Withdraw Consent: You have the right to object to the processing of your personal data or to withdraw your consent at any time, where consent is the legal basis for processing. This will not affect the lawfulness of processing based on consent before its withdrawal.
Right to Grievance Redressal: You have the right to register a complaint with our Grievance Officer regarding any concerns about your personal data.
To exercise any of these rights, please contact our Grievance Officer using the contact details provided in our Privacy Policy. We will respond to your request in accordance with applicable data protection laws.
ApplyLynk reserves the right to modify these Terms at any time. We will notify you of any significant changes by posting the updated Terms on our website or through other appropriate communication channels. Your continued use of the Services after such modifications constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan, India.
